A long-time Managing Director with Mercadien and co-leader of its Forensic and Litigation Support Services Group, Donald Conway specializes in financial forensics and fraud investigations, securities fraud, insolvency and reorganization, commercial litigation support, and financial consulting. His professional experience and accomplishments in these areas are impressive because they not only show a fascinating career trajectory, but also have had a profound impact on his clients, their counsel, debtors, creditors, investors, colleagues, as well as bank, legal and government representatives, and all with whom he interacts. Numerous litigation and financial matters are referred to Don due to the positive results he achieves, and the efficiency and integrity with which he manages clients’ cases.
Don has worn many hats throughout his financial career, building his knowledge and expert reputation with each change. He has served as controller of the New York Mets Baseball Club; executive director of the U.S. Tennis Association (USTA), director of operations for the U.S. Open Tennis Tournament; USTA representative to the U.S. Olympic Committee; and as president of a major Six Flags theme park. In these roles, he worked with the CIA, FBI and other law enforcement agencies on security issues; negotiated contracts for the United States government and major corporations for high-profile, international events; and became experienced in all facets of planning, operating, and financing major and minor league organizations, including managing professional athletes’ finances. Don continues to be a sought-after consultant for financial, tax and litigation issues by companies and individuals in the sports and entertainment industries.
Mr. Conway also provides forensic investigations relating to various business transactions, including securities fraud, Ponzi schemes, bankruptcy fraud and money laundering. On behalf of his clients and their legal counsel, he has worked with the U.S. and NJ Attorneys General Offices, the NJ Bureau of Securities, the FBI, and the SEC Enforcement Division and the IRS and has served as an expert witness before the U.S. Federal Bankruptcy Court and Grand Jury; U.S. District Court of NJ; and various state courts in numerous matters of bankruptcy crimes, insolvency, fraudulent transfers, plans of reorganization and commercial litigation proceedings involving a wide array of accounting and valuation issues.
As evidence of the trust in his insights, responsiveness and communications, Don has served in various trustee roles in a number of substantial, high-profile and long-term cases, most notably as Chapter 11 operating trustee in the bankruptcies of First Jersey Securities president, Robert E. Brennan, and the Golden Corral franchise restaurant chain, and as financial advisor to the trustees of the Birdsall engineering firm and Crazy Eddie retail store bankruptcies. Experienced in off-shore litigation, retention and instruction of counsel, and directing document reviews in foreign jurisdictions, Don also has successfully recovered substantial assets held in off-shore asset protection trusts for his clients.
Unfortunately, Don Conway passed away in January of 2024. He will be sorely missed by his Mercadien family and will live on forever in our hearts.
